Drone strikes carried out by the United States should be viewed in two halves,that is,not all drone strikes carried out by the United States are illegal.The illegality of U.S.drone strikes studied in this paper refers to the strikes carried out by U.S.drones in armed conflicts by violating the basic principles of international humanitarian law and the means and methods of warfare.Drones are aircrafts that are piloted without a human pilot,but are remotely piloted by a ground drone operator and involved in a military strike mission.After 9/11,the United States began to develop drones to target terrorist organizations,given the advantages of drones over conventional weapons in military operations and changes in terrorist activities.However,the severe consequences of some drone strikes by the United States in armed conflict pose challenges to the existing system of international humanitarian law.Drone strikes not only depart from the basic principles of international humanitarian law,but also repeatedly violate the means and methods of warfare under international humanitarian law.As a new type of warfare,drone strikes should be regulated by international humanitarian law.In response to illegal situations in U.S.drone strikes,it is urgent to formulate corresponding international humanitarian law countermeasures to enable future drone strikes to operate under the framework of international law.This paper is divided into four parts.The first part deals with the elaboration of the international humanitarian law system,including the Hague,Geneva and New York laws.At the same time,the concept of international humanitarian law,the law of war,and the law of armed conflict are analyzed to avoid confusion in the logic of writing.The second part lists the causes of U.S.drone strikes,and points out that the nature of U.S.drone strikes is divided into international and non-international armed conflicts.The third part is the core part of this article.Starting from the system of international humanitarian law,this paper analyzes that the drone strikes carried out by the UnitedStates not only violates the basic principles of international humanitarian law,but also uses illegal means and methods of warfare.The fourth part may be related to the innovation of this paper,it comprehensively analyzes the challenges caused by U.S.drone strikes to international humanitarian law,and it is proposed that we should not only be committed to the supervision and protection of international humanitarian law itself,but also pursue the responsibility of the relevant subjects of the U.S.drone strikes from the international judicial level and attach great importance to the right to relief of the victims of the drone strikes.
