Criminal Law Research On Underworld Organization

In China,triad organizations are in the development stage.Most triad groups have evolved from a young criminal group into a vicious force,eventually forming triad organizations,but they have not yet reached the true triad organizations abroad.However,it has seriously damaged the social order and the quality of life of the people.The existence of this organization has caused the people to live in panic and feel insecure.Therefore,in 2018,China carried out anti-crime and anti-evil actions in order to enhance the people's sense of security and maintain a fair social order.Although the basic definition and the four constituent elements of the triad organization have been made in the current laws of our country,there are still doubts about the determination and details of the crime in judicial practice,and there is confusion between the crime and his crime.Therefore,this paper is divided into six parts to discuss the four characteristics of the triad nature organization in practice.The first part mainly expounds the concept of the triad nature organization,and the author distinguishes the triad nature organization from other group crimes.In the second,third,fourth and fifth parts,the author introduces the identification of the criminal law on the four characteristics of triad organizations,and puts forward some controversial issues about the relevant characteristics.In the sixth part,the author tries to put forward some strategies on refining the four characteristics of the triad organization through the above problems in identifying the four characteristics of the triad organization.
