The Study On Nature Of Reproductive Rights From The Perspective Of Conflict

With the opening of the Universal Two-Child policy,the abortion disputes and a series of social news exposure,people's attention to reproductive rights is also on the rise.Fertility is one of the human instincts,and reproductive behavior has a very high universality.So a targeted study of reproductive rights is more conducive to finding relief methods quickly in multiple reproductive rights disputes.At present,there is no perfect legal system for reproductive rights in China.whether female abortion needs the consent of the spouse,whether unauthorized abortion is a violation of reproductive rights or a conflict of rights,how to define the reproductive rights of extramarital births are all need to be solved.In the process of medical treatment,how to treat the disputes of reproductive rights caused by medical malpractice has also become a universal problem in reproductive rights,and all these problems above point to the nature of reproductive rights.Whether the reproductive right is the right of personality or the right of identity,how should the law consider the disputes of reproductive rights between different subjects,and how to intervene in it,has also become an urgent problem to be solved.The purpose of this paper is to start with the types of reproductive rights disputes,through the targeted analysis of reproductive rights disputes with the right of reproductive decision as the core,to put forward their own views on the nature of reproductive rights from the perspective of conflict.Then define the nature,in order to further demonstrate the specific issues of reproductive rights to provide a theoretical basis.
