Research On Rural Land Management Right System

China has a large population and limited cultivated land resources.To guarantee the safety of cultivated land and food security is to guarantee the national security.With the deepening of reform and opening up,the continuous development of China's domestic economy,science and technology and the acceleration of urbanization,a large number of rural labor force into the city to seek development opportunities,rural land therefore large areas of idle.Since China joined the world trade organization in 2001,the disadvantages of decentralized farming of rural land in China have been constantly exposed.Compared with large-scale agriculture in other developed countries,China's agricultural industry is in a weak position and not competitive internationally.In order to ensure the safety of China's arable land and food security,reduce the idle land in rural areas and enhance the competitiveness of China's agricultural products in the world,the reform of China's rural land reform system is extremely urgent based on the above reasons.According to the current situation of rural development in China,the central government has put forward the policy of "ownership,contract right and management right".The policy of"separation of three rights" aims at the development and improvement of the household contracted management right system in China.The contracted management right of land is divided into contracting right and management right.The original rural land system in China is adjusted and a new land management right is added.The system of rural land management rights was born.The system mainly deals with the actual needs of China,s rural economic development.The implementation of the system is conducive to solving the problem of rational utilization of idle land in China's rural areas and appropriate scale development of agriculture.The author hope that through this paper writing for the improvement of the system of rural land management rights have some help,land management system is a relatively new system,the system there is a lack of legislation,the lack of legislation is not only unfavorable to the holder of the right to exercise and protection,will also hinder the development of rural economy in our country and developing the system.It is of great significance to the improvement of land management right system,the increase of farmers' income,the adjustment and upgrading of rural industrial structure,and the promotion of China's agricultural international competitiveness.In this article,through the land management of relevant papers,reading books,read the related law,analyses the existing problems in land management system at the present stage in China,analyzes the problems,and Suggestions to these problems put forward concrete perfect,aims to further perfect the system of land management in our country.This paper mainly studies the land management right system through four parts:the first part of this paper is to comb the concept of land management right,characteristics,etc.This paper from the concept of land management,the analysis of relevant scholars for understanding and definition of the concept of land management rights,and then the author puts forward the definition of the concept of land management rights,the second is the concept of the right to the contracted management of land and land management,for the distinction between the two can be more convenient for us to both understand;Again,is characteristic of land management,in order to induce the land management of the character is different from other rights,and at last the analysis of the nature of the land ownership and about the nature of the land battle at the present stage in China,scholars hold different points of view are in a different view on the point of view that supports the argument.The second part of this paper is the development of the land management rights system and the status of the legislation to help us understand the development of the basic system of rural land and the current law of the land management rights related content.The third part of this paper discusses and analyzes the problems existing in the current legal provisions of land management right.Firstly,it discusses and analyzes the problems existing in the regulations on the transfer of land management rights in China.Including the existing land management right transfer regulation is not clear,easy to cause dispute in practice.Secondly,the problems existing in the financing guarantee system of land management right are analyzed.The financing guarantee system of land management right is relatively new,and the relevant legal norms are also relatively general,which is difficult to realize in the financing guarantee of land management right.Thirdly,it analyzes the problems existing in China's land management right registration system,which has a negative impact on the transfer of land management right,and is not conducive to the protection of the rights and interests of the parties in the land management right.Finally,the paper analyzes the problems existing in the supporting system of land management right transfer in China,including the unsound market trading mechanism of rural land management right and the lack of protection of land management right.The forth part of this paper is aimed at the third part of the existing problems one by one to put forward specific recommendations for improvement.The development and perfection of the land management right system is closely related to the development of the rural economy in our country at the Present stage.Therefore,the perfection of the system is of great importance to the development of our agriculture and even the whole society.
