Research On Legal Issues Of Drug Safety Supervision In China

The legal system of drug safety supervision is named of the laws,regulations and policies concerning the supervision and management of drug's safety production,operation,use and so on.It is of great significance to study Chinese legal system of drug safety supervision.This paper outlines the connotation,historical evolution and legal status of Chinese drug safety supervision legal system.Taking use of the literature research method,comparative analysis method,case analysis method and other research methods,it is found that the fowling five problems existing in Chinese legal system of drug safety supervision through the research and analysis.For example,there are gaps in the legal system of drug examination and approval.The legal system of drug online sales supervision is not perfect.The illegal enterprises have not gotten administrative punishment timely.The legal system of the adverse drug reaction is still required to be improved.At last,the social co-governance mechanism is imperfect.Specifically,the legal system of drug safety supervision in our country attaches importance to the prior examination and approval to ignore the production supervision,and the drug inspection system is much too formalized.At the same time,someone sells false drugs and prescribed drugs illegally by the network.What's more,the administrative penalty for illegal enterprises by the regulatory department is not timely,lack of the legal system for the relief of adverse drug reaction damage,and the relief for adverse drug reaction is not timely.At last,the enterprises has lost the conscious of honesty,the media lack the participation mechanism in the drug safety supervision,and the citizens are not well known the professional knowledge and the right to know about drug safety.In order to perfect the legal system of drug safety supervision in our country,the government should carry out the five aspects.For example,further perfect the legal system of drug examination and approval,perfect the legal system of the online sales supervision for drugs and in our country,increase the administrative punishment of the illegal enterprises,establish and perfect the relief fund system of adverse drug reactions in our country,and fully perfect the mechanism of social co-governance.Specifically,it is necessary to optimize the administrative procedure of drug examination and approval,strengthen the construction of technical examination and approval institutions,clarify the division of responsibilities of drug safety supervision departments,perfect the legal system of drug network sales,standardize the provisions of the network sales forprescription drugs,increase the amount of punitive damages,establish and improve the provisions on adverse drug reactions,and establish a fund system for adverse drug reactions.We should further strengthen the self-supervision of enterprises,the supervision of public opinion in the news media and the propaganda and education to improve citizens' awareness of rights,and give full play to the role of drug industry associations in order to promote the effective operation of the social co-governance mechanism of drug safety in our country.
