On The Conflict And Coordination Between The Privacy Right Of Public Figures And The Public's Right To Know

This paper mainly studies the relationship between the privacy right of public figures and the public's right to know from three aspects.Firstly,starting from the analysis of the basic theory of the privacy right of public figures and the right of the public to know,it is pointed out that there are no specific provisions on the two rights of "privacy right" and "right to know" in China.The basis for its protection is only scattered in the relevant legal provisions of several laws;The author puts forward some views on the personality right of civil code.This paper analyzes the research and legislation on the privacy right of public figures abroad.Secondly,through the analysis of the specific case of different types of public figure pointed out the right to privacy and the public's right to know the current situation of the conflict,and conflict of the specific reason is because of the two rights in the set purpose,the conflict between different interest and legislative defects,and further analyzed the two conflict is the essence of different interests and values.Finally,on the basis of the research in the first two questions,put forward the principle of the priority principle of public interests,meet the reasonable interests,public figures,personal dignity shall be inviolable principle,the principle of case to balance the four conflicts of principle,and from the freedom of the press,perfecting legal system,clear boundaries,improve related main body legal protection consciousness three aspects analyzes the ways to coordinate the conflict,hope to be able to effectively resolve the conflict between them,in order to seek the balance between them.
