Research On The Responsibilities Of External Financing Of Actual Constructors

The current laws and regulations do not make clear provisions on the actual construction workers in the construction process of debt,resulting in different standards in judicial practice,in the apparent agency determination,joint and several liability application,the subject of contractual obligations and responsibility sharing and other issues,the case of different judgments in different regions,even in the same in the same region objectively exist in a large number.In the trial of this kind of case,there are mainly five kinds of judgment ideas,namely,duty behavior,agency behavior,affiliated behavior,management fault,joint borrowing.Based on the analysis of the value concept and advantages and disadvantages of the above-mentioned judgment ideas,this paper puts forward the judicial level on the determination of similar cases to deal with ideas and reference to the neonatal Apgar scoring method,and constructs the apparent proxy identification model.
