On The Dispute Settlement Mechanism Of The Wage Disputes In Professional Sports In China

Since the implementation of the sports reform,the Chinese sports system has been changing from the original national system to the marketization and professionalization.From relying on the state to guarantee the professional league matches and the semi marketization and semi professionalization of the commercial games.However,for athletes,or because of the problem left by history,many of their rights and interests can not be guaranteed.This includes the fact that as a laborer,sports players are prone to encounter difficulties in the face of labor disputes.This article is written to clarify how the professional athletes should protect their legitimate rights and interests in the event of arrears of wages,what are the deficiencies in the construction of sports dispute resolution mechanism in China,and what aspects can we drive in the process of legalization of sports in our pursuit of socialist rule of law.This paper is mainly divided into five chapters,the first chapter is the introduction;The second chapter is an overview of the disputes of unpaid wages in professional sports.It discusses the nature of disputes of unpaid wages in professional sports by analyzing the legal status of athletes and clubs under the existing sports system in China.The third chapter takes the Li Gen case as an entry point to analyze the current mechanism and existing problems of the dispute settlement of unpaid wages in professional sports in China.The fourth chapter enumerates the contents of the dispute resolution mechanism for overseas professional sports arrears,which is worthy of being learned by our judicial practice.The fifth chapter discusses how to establish a diversified solution mechanism for sports disputes in China from the perspectives of mediation,trade association internal dispute settlement,sports arbitration and judicial trial.
