Judicial Determination And Regulation Of Professional Lenders In China

China's professional lenders came into being with the barbaric development of private lending,which has done harm to the country's normal financial order and requires strict legal regulation.From the internal regulations of the regional higher people's courts to the "opinions on several issues concerning handling criminal cases of illegal lending" issued by the two houses on October 21,2019(hereinafter referred to as "opinions on illegal lending"),the regulation of professional lenders began.it can be seen that China is experiencing a process from no legal basis to gradually moving towards standardized development on this issue.In November 2019,the Supreme Court issued the "Minutes of the National Court's Civil and Commercial Trial Work Meeting"(hereinafter referred to as the "Minutes of the Nine People")with clear provisions for professional lenders,further solving the problem of inconsistent identification of professional lenders.As for the judicial identification and regulation of professional lenders in China,the paper first summarizes the professional lenders,leads to the phenomenon of professional lenders according to the actual situation of the development of private lending in China,accurately grasps the definition of professional lenders and analyzes the reasons for the emergence of professional lenders(Chapter one);secondly,the paper analyzes the judicial identification of professional lenders in China In order to better identify the current judicial practice in China encountered in the direction of professional lenders(Chapter ?);again,the paper focuses on combing the current situation of the legal regulation of professional lenders summed up the deficiencies(Chapter ?);finally,in view of the deficiencies of the current legal regulation in China,put forward their own suggestions on the supervision system of professional lenders(Chapter ?).
