Study On WTO Appeal Procedure And Reform

As an important part of the WTO dispute settlement mechanism,the relevant procedures and rules are stipulated in Annex II of the Agreement on Dispute Settlement(DSU)in the Marrakesh Agreement Establishing the World Trade Organization.Since the establishment of the appeal mechanism,although it has made great achievements in the work related to the settlement of world trade disputes,no system can be static.As the world economy continues to develop,trade disputes between members have become increasingly complex.As a result,the appeal mechanism has gradually exposed a number of systemic and institutional issues that have caused the current appeal mechanism to stall.Therefore,the reform of the appeal mechanism has gradually become a consensus among members and has attracted widespread attention worldwide.The purpose of this article is to study and analyze the problems in the appeal mechanism in practice,and put forward suggestions and ideas for reform of the appeal mechanism from a long-term perspective,so as to improve the procedures and rules of the appeal mechanism,promote the settlement of international trade disputes,and effectively maintain the multilateral trading system.This article mainly uses literature research method and case study method.Based on the introduction of the basic procedures and rules of the appeal mechanism,this paper studies and analyzes the shortcomings and shortcomings of the appeal mechanism where the appeal mechanism is located and the selection of members,the scope and duration of the appeal mechanism review,and the report of the appeal mechanism.Then,based on the suggestions and dispute points of each member's reform of the appeal mechanism,he put forward suggestions and ideas for reform of the appeal mechanism.Relevant suggestions and assumptions are mainly focused on four aspects:the establishment of the appellate body and the selection of members,the scope and duration of the appeal mechanism,the report of the appellate body,and the strengthening of non-litigation dispute settlement.Finally,based on the above research,this article puts forward the conclusions and prospects of the reform of the appeal mechanism,and effectively safeguards the multilateral trading system.
