With the rapid development of Internet applications,big data came into being,and soon became the commercial foundation,information support,and source of benefits of a number of e-commerce platforms.But big data collects consumers' personal information and behavior habits,such as registration information,historical purchase records,collections,and search records.This information will be "selectively memorized" and further analyzed and integrated.The application of big data technology is a double-edged sword.On the one hand,e-commerce platforms can greatly improve the quality of their products and services,and provide consumers with more personalized products and services to increase user stickiness;but another in terms of aspects,the e-commerce platform's differentiated pricing based on different consumers 'willingness to purchase products or services not only violates consumers'right to know and fair trade rights,but also disrupts the normal market competition order.In order to avoid infringement on the legitimate rights and interests of consumers,we need to regulate big data price discrimination,improve relevant laws,and bring them into the orbit of rule of law.Improve the rigidity of law enforcement by improving the legislation so that the regulatory authorities have a law to follow.This is the purpose of this article.The full text is divided into three parts,as follows:The first part is an overview of big data price discrimination,mainly elaborating the concept of price discrimination,and on the basis of this theory to define price discrimination under big data,from the development of e-commerce platform,the concealment of behavior itself and consumer rights protection three aspects of difficulty analyze the reasons for the price discrepancy video under big data,and finally analyze the harmfulness of the behavior,starting from three perspectives of consumer rights,operator interests,and market competition order.The second part first analyzes the current status of legal regulations on big data price discrimination,clarifies China's legal regulations on the protection of consumer personal information,and conducts specific discussions on how the "e-commerce law" regulates big data price discrepancies,and then puts forward the current legal regulations deficiencies.The third part is based on the analysis of the second part,and proposes countermeasures to improve the legal regulation of big data price discrimination.Based on the improvement of legislation,it provides more effective solutions for consumers,e-commerce platforms,and regulatory bodies.It is more effective Locally regulate big data price discrimination.
