Research On The Standardized Implementation Of Notification Commitment System

As a new system created by the local government,notification commitment system is based on the advanced experience of the local government,and then rises to a macro advocacy in the Regulations on Optimization Business Environment.The system of notification commitment has been practiced and popularized all over the country,and it is favored by the administrative organs and the relative people with its high efficiency and convenience.But in the process of promoting from the local to the whole country,there are also some problems,such as the lack of unified norms,imperfect procedural provisions,and imperfect supporting implementation mechanism.The purpose of this article is to standardize the implementation of the notification commitment system through unifying legislation,strengthening supervision and improving supporting systems from the perspective of integrity and dynamics by combining the theoretical and practical experience of the implementation of the notification commitment system and fully applying the administrative process theory,so as to better extend this successful experience to the whole country.The article is divided into three parts.The first part studies the general theory of the implementation of the notification commitment system,analyzes its concept,implementation rules and legal attributes,and believes that its essence is the innovation of the administrative licensing work mode by the local government in accordance with the law;its advantages are efficient convenience for the people,clear content of rights and obligations;the implementation focuses on form review,and the core is post supervision.The positive significance of the standardized implementation of the notification commitment system for the reform of administrative law enforcement and the construction of the legal business environment is clarified.And through the introduction of the theory of administrative process and the theory of service-oriented government to provide theoretical support for the standardization of the implementation of the notification commitment system.In the second part,through the analysis of the original purpose of the notification commitment system legislation,the summary of the practical situation in the representative field,and the investigation of the application of the notification commitment system in the online administrative process during the Covid-19 epidemic,it is concluded that the notification commitment system conforms to the principles and requirements of the Administrative Licensing Law and adapts to the development trend of e-government inthe future.At the same time,the state is also deploying and implementing the pilot work to prepare for the following unified legislation and regulations.However,through the analysis of the current situation of the practice and typical cases of the notification commitment system,it is concluded that there are some problems in its implementation,such as the lack of unity legislation,the lack of relief mechanism and the insufficient supply of supporting systems,which seriously hinder the implementation and promotion of the notification commitment system.In the third part,based on the experience of foreign countries,the author proposes the standardized path for the implementation of the notification commitment system.Based on Inform the Commitment System to Implement the Pilot Work Plan,the ministry of justice shall take the lead in formulating Measures for the Implementation of the Notification Commitment System to standardize the procedures of notification,commitment,supervision and relief.At the same time,we should strengthen the supervision of administrative organs and counterparts,especially strictly regulate the exercise of post-supervision power and administrative organs' discretion power,and supervise and punish counterparts' false commitments.Establish and improve the credit review and punishment system related to the implementation of the notification commitment system,give full play to the service,guidance and supervision role of industry associations,and jointly ensure the standardized implementation of the notification commitment system.Through the standardized research on the implementation of the notification commitment system,this paper hopes to make it form a good situation in practice and promotion with laws to be followed,strict and reasonable procedures,strong supervision and adequate supply of supporting systems,so as to provide theoretical support for the long-term development of the notification commitment system.Furthermore,we will seek to inform the feasible experience of the notification commitment system in further optimizing the business environment in China.By combining with the development of e-government for the convenience of the public,and improve the service ability of the government,so as to provide impetus for continuing to deepen the reform of administrative law enforcement,economic transformation and the building of a law-based business environment in China.
