Research On Implied License System Of Copyright Under The Environment Of "Internet Plus"

With the further development of "Internet Plus" and the development and innovation of the new generation of internet technology and information services platform,it has given birth to a new type of internet demand and information exchange mode,and the dissemination of knowledge and the protection of copyright also show unprecedented trends and new forms.Since the Premier,Li Keqiang,proposed the "Internet Plus" plan in the 11 st.government financial work report,the "Internet Plus" has become a hot topic of the wide public concern.It already represents the new economic,social and cultural development of an open country and its specific economic changes and development.However,in the traditional copyright legal system of our country,the model including case-by-case licensing,rational use and so on has gradually been difficult to complete the original tasks such as protecting rights and interests,balancing interests and other tasks and the complicated "Internet Plus" environment.Today's "Internet Plus" network environment contains the networking,mobile interconnection,big data,cloud computing,and has post-modern characteristics.So how to achieve fairness,legitimacy and necessity,while improving the efficiency of the dissemination of works,so as to achieve a balanced distribution of benefits,maintain copyright and even intellectual property capital operation,has become a bottleneck in the current copyright development process.Copyright implied licensing system is undoubtedly one of the most in line systems with the above requirements.Based on the theory of copyright implied license system,this paper deeply discussed the connotation,characteristics,application scope and superiority of copyright implied license system under the current "Internet Plus" environment.Through the investigation of legislation,judicature and practice cases of copyright implied license system in internet environment at home and abroad,this paper summarized our own experience and studied the high quality experience abroad.At the same time,this paper analyzed the sub-elements such as mobile interconnection,big data,cloud computing and network environment with post-modern characteristics in "Internet Plus",put forward the conflicts and difficulties of copyright implied license system running inthese environments.Finally,combined with these difficulties and domestic and foreign experience,this paper proposed some suggestions for system optimization of copyright implied licensing system under the "Internet Plus" environment.This paper focused on the construction,legitimacy and necessity of its logical system,and how to solve the problems existing in other "Internet Plus" sub-environment.
