The right of communication is a constitutional right which is to guarantee the mutual communication between people in society.The development of technology lead to some new characteristics.Instant messaging tools——represented by WeChat and QQ——have instead of traditional letters as the most important information transmission way.Nowadays,the integrating of communication and digital technology has broadened the connotation and extension of the right of communication.However,The right is more likely to be violated in two subjects.Firstly,the government's monitoring and interception on communications is not improper and it lacks the due process when it detains and retrieves electronic data.Secondly,the employer use the monitoring software to have improper management on employees.Besides,it also steals,tampers,and copies employees'information frequently on the Internet,it even always send the messages and information compulsorily.However,the protection of the right is lack of specific provisions,the definition of its content is vague.It lacks complete limitation procedure,effective administrative protection and sufficient judicial remedy.Therefore,we must improve the speed of legislation to protect The right of communication on the internet and make clear principle about how to limit this kind of right.We also could Optimize the net management and open more channels of judicial remedy.Only in this way,can we make the constitution right of the citizen of communication to be truly protected and implemented in the era of internet.
