Research On The Wage Arrers Of Professional Athletes

In recent years,the news of professional athletes' arrears of wages has frequently come out in China.The arrears of wages in clubs have seriously damaged the labor rights of professional athletes.Professional athletes,as special laborers,should enjoy the same labor rights and interests as ordinary laborers,but due to the particularity of the sports industry,there are problems such as lack of relief channels and high relief costs,and their legal rights and interests are often difficult to protect.The first part of this article raises questions,introduces the related concepts,and stresses that professional athletes are special laborers.Then,starting from the typical cases of professional athletes' arrears of wages,analyzes the existing laws and regulations concerning arrears of professional clubs in China.The second part analyzes the reasons for the frequent occurrence of wage arrears in the professional sports industry,mainly including imbalances in professional clubs 'income and expenditures,poor awareness of the legal rights of athletes,loopholes in sports associations' arrears regulations,ambiguous jurisdiction over sports disputes,and lack of protection for arrears.The third part is to introduce the experience of managing the arrears of professional athletes outside the region' mainly from three aspects:punishment for arrears of wages,protection of arrears of wages,and judicial intervention.The fourth part is to put forward the idea of resolving the wage arrears of professional athletes in China.The first is to improve the institutional arrangements for wage arrears regulations,simplify the procedures for athletes who are in arrears to recover free life,and strengthen the supervision of all departments on arrears;the second is to improve the resolution of sports disputes,clarify the legitimacy of judicial intervention,and gradually establish specialized sports arbitration institutions;the third is to establish professional athletes 'unions;finally establish a professional athletes' arrears protection system.
