Research On The System Of Defendants Confessing Guilt,Accepting Punishment And Giving Leniency

As a litigation system with the largest number of new provisions in the 2018 Criminal Procedure Law,the system of lenient punishment based on the unity of justice and efficiency is an important embodiment of responding to the diversity of criminal procedures and multilevel exploration.It is the embodiment of fully implementing the policy of combining leniency with severity,reducing contradictions and confrontation and promoting social harmony.It is the embodiment of following the law of criminal proceedings,inclining the limited allocation of judicial resources to deal with complicated and difficult cases and non-guilty cases,constructing a fine trial of major and difficult cases and non-guilty cases,and a dual-regulation procedure of simple and quick trial of minor guilty cases,thus creating conditions for the reform of criminal proceedings system centered on in-depth recommendation of trials.However,there are still some problems in our country's system of lenient punishment for defendants who plead guilty and admit punishment,such as unclear standards of lenient punishment,imperfect review procedures,insufficient allocation of duty lawyers' authority,and the relief mechanism for defendants who plead guilty and admit punishment to be improved.Based on the analysis of the new contents of the system of lenient punishment for defendants' confession and punishment in China's Criminal Procedure Law.the author inspects the system of lenient punishment for defendants' confession and punishment in foreign countries,draws on the useful experience of foreign countries,and put forward countermeasures to improve the system extenuating confession of the accused and punishment in China,hoping to further promote the system of lenient punishment for defendants' confession and punishment in China.
