Research On The Optimization Of Law-based Business Environment

Under the background of globalization,the business environment has become an important part of a country’s soft power,and also become a new field for the game in all countries of the world.Since the reform and opening up,with the rapid development of economy,China’s emphasis on the business environment is getting higher and higher.At present,China’s characteristic socialism has entered a new era,the conditions to attract enterprises are no longer only rely on resources and preferential policies,but more reflected in the enterprise market access,management.exit and other aspects of the institutional environment.Under the background of this era,the optimization of the environment of the rule of law is becoming more and more important to our country.The characteristics of comprehensive and dynamic business environment determine that optimizing the business environment is not a one-day work,it is a long-term,systematic project.In the optimization work,we should adhere to the unity of two points and key points,not only to enhance China’s infrastructure and other hard environment,but also pay attention to the system,law and other soft environment to support,safeguard and promote the economy.Since the 18th National Congress of the Communist Party of China,the business environment has been developing steadily and has made a series of achievements in the institutional environment,the decision-making environment of laws and regulations,the administrative environment according to law,the administrative environment,the power restriction and supervision of environmental construction.At the same time,we should be aware that there are still many acts in practice that damage the business environment.These actions pose a challenge to the business environment of the rule of law,and also reflect that there is still a big gap between China’s business environment and the international advanced level.Therefore,under the background of the new era,this paper discusses the state of the legal business environment with the basic theory of the business environment,and through the practice of local legislation and the optimization of the local business environment,in order to find the problems in the process of optimizing the business environment in China.And based on relevant legislation to build the rule of law business environment index system,and further put forward the solution of the proposal and optimization of the path.The main part of this paper is divided into five chapters,the basic theory of the business environment,the historical evolution of the optimization of the business environment,the practical study of the optimization of the business environment by law,the construction of the evaluation index system of the rule of law business environment,and the path choice of the optimization of the business environment by law.The first chapter of the basic theory of the business environment,mainly discusses the concept and characteristics of the business environment,the basic attributes of the rule of law business environment,the rule of law business environment how to put forward,the rule of law business environment four aspects of connotation and the rule of law business environment optimization of the core.The second chapter of the history of the optimization of the business environment by law,mainly introduces the business environment before the reform and opening up,the stage of investment promotion and the new era to optimize the business environment in the evolution of government responsibility content.The third chapter first through the Heilongjiang,Liaoning,Shandong,Beijing,Shanghai five local business local laws and regulations of the text of comparative analysis,to examine the business environment optimization in practice,to provide a basis for the construction of the indicator system.Secondly,through five typical cases of destroying the business environment in five regions,the problems in the optimization of China’s business environment are analyzed.Chapter 4 is the construction of the environmental index system of the rule of law business,which is mainly constructed through the Regulations of the State Council on the Optimization of the Business Environment and the contents of local laws and regulations in the five regions.The fifth chapter is the path choice of the optimization of the environment of the rule of law,and the solution is put forward according to the relevant content of the index system,in view of the analysis of the indicators and the problems existing in practice.
