Research On Copyright Issues Concerning User Generated Content

In the era of Web2.0,knowledge sharing and free communication are promoted.UGC has developed rapidly in this era.Active creation has become a feature in the UGC era.Users actively create,publish,and actively disseminate information,instead of passively receiving information.User participation is greatly improved and sharing is greatly improved.However,it cannot be ignored that UGC has suffered from copyright infringement while flourishing.In order to protect the cultural spirit of the free transmission,sharing knowledge,and free exchange of culture in the internet era,in order to protect UGC copyright,it is necessary to analyze the reasons for UGC infringement.According to the reasons for countermeasures,we can put forward protection suggestions from the aspects of UGC platforms infringement and UGC users infringement to better protect the development of UGC.The first chapter of this article is a general discussion of UGC.Firstly,it defines user-generated content,summarizes the basis of user-generated content classification,proposes that user-generated content should be protected by copyright,and mines the value of user-generated content;The second chapter mainly interprets the content and value of the knowledge sharing license agreement,analyzes the content of the user service license agreement and its existing problems;The third chapter analyzes the UGC platforms and UGC users infringing on the copyrights of others,as well as the UGC platform and UGC user's copyright infringement by others,analyzes the elements of infringement,and analyzes the exemption situation of UGC platform's copyright infringement and UGC user's copyright infringement by other people;The fourth chapter of this article analyzes the rights protection dilemma of user-generated content,the legal system cannot adapt to the development of the UGC model,and the UGC development model will have a huge impact on the existing copyright legal system.Therefore,it is necessary to find the balance of the copyright rights in the UGC environment;The last chapter of this article puts forward countermeasures and suggestions for UGC copyright infringement,and adopts measures to change the copyright collective management system for UGC platforms are infringed on copyright by others;For UGC platform infringements on the copyrights of others,legislation should be provided for the minimum standards and usage rules of anti-infringement filtering technology,perfect use of "safe haven" rules,and balance the information status between websites and users,such as improving user service usage licensing agreement,etc;In view of the infringement of UGC users,take measures to promote the use of the CC agreement and implement the real-name system of the network background.In short,targeted suggestions should be made to analyze the model suitable for UGC development and realize the spirit of free and equal internet and knowledge sharing.The article mainly uses the literature research method,and it also uses case study method,reads a lot of literature about UGC,analyzes cases,summarizes the concept of UGC,clarifies the basis of UGC's copyright protection,and proposes corresponding suggestions for different types of infringements to protect UGC copyright.This article mainly summarizes the concept and type of UGC,analyzes the risk of UGC being infringed,and proposes targeted measures to protect UGC copyright.A large part of the reason why UGC is infringed is that the existing copyright cannot adapt to the UGC development model.The UGC development model will have an impact on the copyright legal system.Therefore,it is necessary to infringe the copyrights of others on the UGC platform and UGC users,UGC platforms and UGC users infringement of copyrights by others,put forward targeted opinions from different angles to ensure that UGC development is protected from greater infringement risks.In the past,the literature mainly researched a single type of UGC copyright,such as researching the copyright of Weibo,researching the copyright of website videos,and less research on the overall copyright of UGC.This article starts from UGC as a whole,targeting UGC platform and UGC users,from infringement from different perspectives of the copyrights of others or copyright infringements,a comprehensive analysis of UGC copyrights is carried out,and targeted and effective measures are proposed to comprehensively protect UGC copyrights.
