Research On Competitive Neutrality System

Competition neutrality system is the latest practice in the field of market competition in the world and has achieved a lot of remarkable results in maintaining market competition.More and more countries and organizations accept and recognize,but there is also a branch of countries and organizations use the theory of maintaining fair market competition and regulating government behavior in competition neutrality to restrict some countries with more developed capital to participate in the international market competition,the root of which is the increasingly serious trade protectionism.Then under this international trend,China is in the development stage of economic system reform,how to understand and implement the competition neutrality system is a major issue that should be faced at present.The first part analyzes and compares the definition of competition neutrality by various organizations and countries in the world,including Australia,which initially proposed the concept of competition neutrality,OECD,the largest single organization in the world in terms of market competition,and TPP led by the United States.This paper comprehensively defines the basic concept and corresponding legal status of the competitive neutrality system as a measure of domestic economic reform in China,and then introduces the relevant content and theory of the competitive neutrality system.The second part selects three typical international versions of competition neutrality system for comparative study:The Australian version of competition neutrality system as domestic competition policy,the OECD version of competition neutrality system as international soft law and the TPP version of competition neutrality system as mandatory entry qualification.The similarities and characteristics among the three are summarized,and the conclusion that the competitive neutrality has diversity is drawn.Then on the basis of analysis and argumentation,this paper puts forward the position and direction of China to cope with the competition neutral system under the current domestic and foreign background?The third part emphatically analyzes the necessity and feasibility of implementing the competition neutral system in Our country.In our country the constitution of the People' s Republic of China,the anti-monopoly law,"the state of our" as an example demonstrates not only in domestic competition laws and regulations of our country has a gap,in the existing laws and regulations of competitive neutrality system idea also have advocated,secondly analyses the current competition policy in our country,points out that the plight of our domestic competition policy and the way out,the last situation about competition neutral system of concrete practice in our country the necessity and feasibi lity of the implementation of the system in China is obtained.The fourth part is the summary of the whole article is also the core part that puts forward the basic path of China' s implementation of the competitive neutrality system,the basic position,and the response in the international market competition.Take the basics for example,Firstly,the basic concept of competition neutrality system as a domestic reform measure should be clarified.The second is to differentiate and analyze the concept of state-owned enterprises in the application scope of China' s implementation of the competition neutrality system,and determine the definition of the concept of state-owned enterprises in the field of state-owned capital and state-owned enterprise supervision,namely state-owned wholly-owned enterprises,holding enterprises and companies;Third,it puts forward nine requirements including access,taxation,operation,supervision and law for the basic code of conduct applicable to the competition neutrality system in China.The fourth is to improve the implementation mechanism of China's competitive neutrality system,namely to establish a complete and systematic complaint mechanism,including the complaint subject,the object of complaint,review body and other relevant Suggestions;Fifth,the relevant supporting measures for the implementation of the system are suggested,including the improvement of the fair competition review system,the establishment and improvement of the information disclosure system and the main obstacles for the reform of China' s state-owned enterprises.
