Research On Automated Administration From The Perspective Of Administrative Law

Automated administration is a new administrative method produced by the application of science and technology such as artificial intelligence,big data analysis,and algorithms in the field of administrative governance.In recent years,it has become one of the topics of widespread concern in the academic community.Compared with traditional administrative governance methods,automated administration has realized administrative modernization and wisdom in the administrative governance process,and has brought advantages such as fairness,efficiency,precision and convenience to the people.However,automated administration has also challenged four aspects of the basic principles of administrative law,the law of administrative entities,the law of administrative procedures,and the law of administrative relief.How to balance the relationship between the application of science and technology in the field of administrative governance and administrative law has become an urgent issue for China.In order to make the administrative subject use automated administration legally,reasonably and justly in the new situation,this article will define the new administrative method of automated administration,make a type division,and summarize the characteristics from the perspective of administrative law.This article will propose a legal regulatory path for automated administration from the aspects of effectiveness,scope of application,procedural guarantees,relief channels,supervision mechanisms:China needs to clearly define automated administration in the form of law,clarify the relationship between automated administrative governance and traditional administrative governance,the scope of application of automated administration,strengthen the procedural protection of administrative counterparts in automated administration,clarify the relief approach for automated administration and strengthen the supervision mechanism of automated administration.
