With the rapid development of science and technology,driverless cars begin to enter people’s sight and enter people’s lives.It causes a lot of criminal problems.In addition,it brings a shock to traditional criminal trials because of its indefinite jurisdiction,difficult usage of appraisal opinion and difficult proof of case.In order to unify the fight to crimes and the protection of human rights,it is necessary to carry out the regulations of criminal trial procedure for the specialty of driverless cars crimes.First of all,when determining the jurisdiction for the trial of driverless car crime cases,by combing the basic basis and idea and theory of level jurisdiction and regional jurisdiction,it is proposed that such cases should be governed by the intermediate people’s court and the scope of the criminal place should be expanded.Secondly,because the driverless cars criminal cases are based on high-technology,which is high-professional.There is no doubt that heavy usage of appraisal opinions as proof is essential.However,this kind of appraisal is different from other appraisals.Therefore,it is necessary to clarify the specific application rules of such appraisal opinions through special regulations on thequalifications of appraisers,special cross-examination rules for appraisal opinions at the court trial,and certification rules,so as to solve the difficult problems in the use of appraisal opinions.At last,in the handling of certification activities,to solve the high-difficulty certification of driverless car crime cases according to the responsibilities partition of prosecutor and defendant and the related decrease of certification standard.Since the criminal prosecution of driverless car crime cases is more advanced,there are not many materials and examples for reference,so the solutions proposed here may lack some practicality,and it is inevitable if they are biased and insufficient.However,we must pay more attention and respond reasonably to the legal gap brought by emerging things.To provide intellectual support for legislation through theoretical research—The purpose of this article is to provide reference solutions and assumptions for the special problems of driverless car crime in criminal lawsuit and hope to get suggestions from all parties.
