| In recent years,the cases of labor dispute in Quangang District are on the rise,and the types of labor disputes are becoming more and more complex and diversified,and it is more and more difficult to deal with them.The mediation of labor disputes is conducive to improving the automatic performance rate of the parties,reducing the litigation rate and petition rate,reducing litigation resources and costs,easing conflicts between the parties,reducing confrontational conflicts,and building a harmonious labor relationship.Based on this,this paper focuses on the issue of the mediation in labor disputes in Quangang District.First of all,this paper expounds the scope of accepting cases in the mediation of labor disputes in Quangang District,summarizes and sorts out five types of mediation institutions and personnel by collecting data,analyzes the mediation process of five types of mediation institutions by combining the case and flow chart,summarizes and sorts out the cases of mediation and practices in mobilizing the enthusiasm of mediation institutions by collecting data.Secondly,using the polycentric governance theory,combining the theory with my work practice,establishing the analysis framework of polycentric governance,using case and interview methods to carry out research,combing out the following problems in the mediation of labor disputes in Quangang District from the perspective of polycentric governance: "the government dominates and internal mediation has many shortcomings"," Low participation of social organizations" and " limited role of the private sector".It is found that the reasons for these problems are: "the inaccurate role of government and the lag of internal mediation construction ","the lack of material and institutional security in social organizations",and "the enterprises and some lawyers of law firms value profit more than responsibility".Finally,from the analysis framework of the polycentric governance,this paper proposes to improve the mediation of labor disputes in Quangang District and build a harmonious labor relationship from "strengthening the transformation of government role and the construction of internal mediation","actively cultivating the social mediation organization of labor dispute " and "uniting the private sector". |
