| The allocation of law enforcement power in townships and towns is an important subject for the study of township governance systems in China.In recent years,the Chinese government has been committed to promoting comprehensive law enforcement reform in towns.However,the legal basis of township law enforcement is very weak: the township government lacks the qualifications of law enforcement subjects,lacks the legal authority to exercise independent and relatively centralized enforcement of law enforcement powers,and lacks the legal basis for the functional positioning of the township law enforcement agencies and the distribution of powers.However,the supply of law enforcement functions of the township government is closely related to the stability and sustainability of rural social development.Therefore,this article starts with the study of the allocation of law enforcement powers in townships and towns,and combines the institutional ideas for the construction of the township law enforcement system in the "Implementation Opinions on Promoting Grassroots Integrated Approval Service Law Enforcement Forces." Explore the allocation of law enforcement power.The research theme of this article is the issue of the rule of law in the distribution of law enforcement power at the township level,which specifically includes three aspects: the first is the issue of rationally setting up the law enforcement functions of the township government,including function definition and scope;Issues,including statutory responsibilities,power boundaries,responsibilities,and the protection of the rule of law;the third is to improve the system security of the township government’s law enforcement power allocation,including the establishment of law enforcement agencies,management,and accountability and supervision of law enforcement powers.This article is mainly composed of three parts: The first part explains the current situation and problems of law enforcement supply in China’s townships and villages,mainly focusing on the function legislation and power distribution of township and village governments.The second part carries out a theoretical analysis of the research theme.First,it analyzes the law enforcement functions of township governments from three perspectives:logic,experience,and empirical evidence.Second,it allocates the law enforcement power of townships from the aspects of legal nature,allocation principles,sources of power,and operation methods.Perform analysis.The third part explores feasible paths and suggestionsfor improvement,focusing on the issue of norms of decentralization and the establishment of law enforcement agencies. |
