Research On Legal Issues Of The Qualification Of Profit-making Non-governmental Educational Institutions

The qualification system for managing profitable private education institutions is essentially an administrative licensing system.In other words,it is an accessible administrative permission set for the subjects intending to engage in private education.Currently,a series of laws and norms with Promotion Law on Private Education as the center have set abundant and specific conditions for the qualification system for profitable private education institutions,including teachers,funds,school location,environmental protection,the access system,and the information publicity system,etc.In practice,there are some problems for the qualification system for managing profitable private education institutions,such as excessively rigorous and unclassified access conditions,differentiated establishment regulations in various regions,unclear access channels,the relative shortage of the authenticity examination mechanism and the law enforcement inspection mechanism for business qualification,as well as insufficient information publicity.In order to solve them,the access conditions of profitable private education institutions should be basically unified through laws or administrative regulations nationwide and be improved from the following aspects.Firstly,we should implement a unified classification access system and set up conditions for gaining business qualification based on the classification of teaching contents and teaching models.Secondly,we must strictly forbid illegal business permits and strengthen the authenticity verification of those who apply for the business license.Meanwhile,we need to intensify the inspection mechanism of illegal business permits.Based on this,it is necessary to set up a system to seriously ban those who infringe upon major legal interests from engaging in relevant education training activities.Finally,we ought to upgrade the information publicity system and the information censorship system to clarify the fundamental scope of information publicity,intensify the publicity and censorship of the faculty,and establish the pertinent accountability system.
