Marriage is an important link to maintain the family,and the family is the basic unit of society.The health of the marriage relationship has greatly affected the stability of the society.With the rapid development of China's economy and science and technology,it has brought huge economic benefits to people.There are frequent infringements such as derailment,domestic violence,abuse of husband and wife property,etc.Remedies for civil liability for tort in marriage are very limited.The marriage law stipulates that the compensation for damages is based on divorce,which makes many victims who do not want to divorce have to take the road of divorce to protect their legitimate rights and interests.The author believes that the establishment of a civil liability system for marriage infringement can fundamentally solve the dilemma of infringement between husbands and wives without effective compensation,which is not only conducive to protecting the legitimate rights and interests of both husbands and wives,but also to maintaining family harmony and society of stability.The author mainly interprets the civil liability system of tort in marriage from four parts.The first part is introduction.It mainly elaborates the background of the topic,the purpose and significance of the research,and introduces the current research status at home and abroad,and introduces the main content of the paper.The second part is solving conceptual problems.First of all,according to the different understandings of in-marital torts in academia at present,this article gives a definition of in-marital infringements,and classifies the in-marital infringements based on the object of in-marital infringement.The connotation of civil liability for acts and its legal constituents.The third part mainly expounds the problems existing in the civil liability system of tort in marriage.This part is mainly based on the research status of Chinese scholars,and specifically analyzes the problems of civil liability for infringement in marriage.The fourth part addresses the problems existing in civil liability for infringement in marriage in China,and gives corresponding suggestions for improving the civil liability for infringement in marriage.
