Problems Existing In Criminal Investigation Of Environmental Resources Crimes By Chinese Public Security Organs And The Countermeasures

In recent years,the continuous acceleration of China's international construction process has made great progresses in China's existing economic structure and social infrastructure,but there are many problems coming with it,such as the increasing environmental pollution and the destruction in resources and energy.While the socialist construction is entering a new era,ecological civilization construction and ecological environmental protection have also welcome a new stage of development,where the greenness and beauty become the developing direction of this new era.The report of the 19 th CPC National Congress emphatically carried out a comprehensive summary and systematic deployment on the ecological civilization construction and ecological environmental protection,putting forward many new ideas,new concepts,new goals and new requirements.However,it is still a common problem that environmental protection in various regions gives the way to the economic development,which is due to the insufficient supervision and enforcement.Ecological environmental issues have been paid more widespread attentions by the society,and it can't be delayed for fighting against the crimes in environmental resource.In addition,the public security organ is such a department with both administrative and criminal powers,and it is able to smoothly solve the problems that were dealt with insufficient law enforcement by the environmental supervision department in the past,which is conducive to the prevention of environmental pollution and the protection of natural resources.However,there are still five aspects of realistic difficulties for China's crime investigation work in environmental resource,such as insufficient legal basis,narrow case sources,difficulties in collecting evidence,low professional degrees in investigating subjects,the lack of identification mechanism,and the unfavorable institutional guarantee.Based on this,the thesis tries to make a research on the practices of criminal investigation in environmental resources in H province of China in 2018 and analyze the dilemmas for the current crime investigation work in environmental resource.It also combines with the investigation and survey on the current situations of crime cases in environmental resource which are investigated and handled by grass-roots investigation agencies to solve the above problems from a practical perspective.And then,it makes pointed references for the operable suggestions from five levels,which are to perfect legal basis,broaden the clue sources,improve the evidence collection system,strengthen the professional construction on the investigation,standardize the identification system,as well as improve the coordination and supervision mechanism,in order to play a positive promoting role in studying the prevention and control on the crimes.
