Research On Legal Personality Of Artificial Intelligence Agent

At present,the intelligence degree of strong artificial intelligence has been close to the level of human intelligence,which brings us many benefits,but also brings many new legal issues.Taking driverless driving as an example,its technological maturity and multiple benefits have made it possible.However,cars have an important position and influence in human life,new technologies are not easy to enter the existing social life,and related system design needs to be fully prepared as much as possible.Among them,the responsibility for traffic accidents of driverless cars may be a direct problem.The foundation and kernel of the question is whether artificial intelligence agents have legal personality.There are two main types of views in the academic circle: positive and negative.These views have some reasons,but they do not strictly follow the juristic logic of the concept of legal subject.Therefore,they cannot deny the legal personality status of artificial intelligence agents.The legal subject,as a legal qualification,is a pure legal abstraction.Just because of technical convenience,it is used to condense and assume the assigned responsibilities,and give artificial intelligence agents such as driverless cars the legal personality without theoretical obstacles.In practice,the Law Commission of the European Parliament has proposed giving legal personality to sophisticated robots,and new regulations in Florida in 2019 explicitly treat driverless systems engaged as the operator.In view of the maturity and multiple benefits of driverless technology,it should be understood and accepted in the new social background.It is necessary to establish the legal subject qualification of artificial intelligence agents such as driverless cars,and to determine and assume the liability by compulsory insurance,so as to prepare for its smooth entry into society.
