An Empirical Study On The Control Of Death Penalty For Drug Crimes

China is one of the few countries that retains the death penalty,and the proportion of death penalty application of drug crimes has always been the highest in non-violent crimes.Under the background of restricting the death penalty as the legislative reform orientation of death penalty,restricting the application of the death penalty for drug crimes will be of great significance to reduce the overall number of death sentences and even the abolition process of non-violent crimes.Although the limitation effect of the ruling rules on the death penalty is "effective" but more "limited",it is necessary to further restrict the coverage of "death penalty circle" and to correct the outstanding problems in operation.As an important part of the study on the death penalty,this paper will use "drug crime death penalty control" as a center,"death penalty benchmark" and "influence factors" two entry points,reveal the objective reality of the application of the death penalty for drug crimes,explore the main factors affecting the application of the death penalty for drug crimes,try to build an optimization strategy of drug crime death penalty control.This paper has five chapters,the content is mainly divided into drug crime death penalty application of the norms combing,the application of the death penalty of the overall trend of empirical observation,affecting the application of the death penalty four key factors and effective control of the application of the death penalty basic strategy.Based on the judgment of more than 10,000 drug death penalty cases,this paper studies the application of the death penalty for drug crimes.The research found that the rate of immediate execution of drug crimes showed a downward trend,at the same time,the imbalance of the application of the death penalty is more prominent,the application of the death penalty for transportation of drugs is too much,the main offender's death penalty is more serious and so on.In terms of influencing factors,the key factors such as quantity and content should be the focus of measures to limit the death penalty.In the future,we should continue to strictly grasp the standards of the death penalty,devote ourselves to changing the excessive reliance on the quantity of drugs,attach importance to the role of light-case,build a multi-level sentencing level,reduce or even abolish the death penalty for transportation of drug crimes,and give full play to the exemplary significance of the guiding documents to promote the reform process of the death penalty for drug crimes to develop in a deep direction.
