A Study On Regulation Of Bike-sharing | Posted on:2021-02-15 | Degree:Master | Type:Thesis | Country:China | Candidate:J X Hao | Full Text:PDF | GTID:2416330611980545 | Subject:legal | Abstract/Summary: | PDF Full Text Request | Bike-sharing is designed to meet the needs of slow traffic system,and is the product of the deep integration of traditional leasing industry and Internet technology.It only took more than two years for the bike-sharing to become popular,but neither the market nor the law-executor prepared for the swarming of bike-sharing,causing serious social problems.This article takes the legal regulation of bike-sharing as the topic,and uses legal thinking to try to solve the problems in the development of bike-sharing.The first part is an overview of the bike-sharing,discussing the concept,characteristics,and historical development of bike-sharing.Through the discussion of the concept of bike-sharing,it is explained that the essential feature of bike-sharing is Internet time-sharing,which further clarifies the difference between bike-sharing,sharing economy and public products.By discussing the development history of bike-sharing,the characteristic of bike-sharing are illustrated in different development stages.The second part discusses the necessity of regulation of bike-sharing from the perspective of order maintenance and danger prevention.The former is that the operating enterprises dispensing bike-sharing excessively far beyond the capacity of the area and the users parking randomly,stealing and damaging intentionally in the use of bike-sharing damages urban traffic order.The latter is that the operating enterprises have many risks caused by unauthorized use of deposits,unqualified product quality,incomplete protection of private information.The third part discusses the current status of bike-sharing regulation from the perspective of policy formulation and administrative enforcement of law.It points out that there are many problems in the regulation of bike-sharing,such as incomplete market access laws,inadequate collaborative supervision mechanisms,and illegal user's supervision loopholes.The fourth part discusses the reconstruction of the regulation of bike-sharing from the perspective of the reform of “Delegating powers,Improving Regulation,and Strengthening Services”.It points out that Delegating powersincludes delegating powers to the lower government and the market,clarifies the boundary between the government and the market;co-regulation is the optimal choice for Improving Regulation and the direction of Strengthening Services. | Keywords/Search Tags: | bike-sharing, co-regulation, the reform of "Delegating powers,Improving Regulation,and Strengthening Services" | PDF Full Text Request | Related items |
