Study On The Practice Of Relatives' Concealment System

As a system with strong human relations in the history of the legal system of our country,the system of relative concealment was manifested as the principle of relative concealment in ancient times.Its meaning is to allow a certain range of relatives to conceal each other's crimes,not to be punished as crimes.As an important criminal legal system,it is of profound significance to protect the right of close relatives,maintain family stability and promote social harmony.The value and importance of the relative concealment system has always been the focus of academic discussion.The Penal Code does not make exceptions to the act of concealment between relatives,but at present there are relevant ideas in procedural law and judicial interpretation.Criminal Procedure Code It stipulates that close relatives have immunity to testify in court,and in entity,the Supreme People's Court has refined the sentencing of close relatives' acts of concealing the proceeds of crime and the proceeds of crime,as well as the acts of close relatives harbouring drug criminals and sheltering addicts.From the case of judicial practice,there are still some problems in the application of this system.Therefore,this paper points out the problems and reasons of the relative concealment system in practice,based on the legal origin of the relative concealment system and the extraterritorial provisions on the relative concealment behavior.Finally,combined with the interpretation of the value of the relative concealment system,this paper tries to put forward concrete and feasible suggestions for the regulation of the relative concealment behavior.
