In recent years,because the level of economic development in China is constantly improving,the gap between urban and rural areas is also becoming smaller and smaller.As a result,housing prices continue to rise,so that people with housing needs,because they can not afford commercial housing and choose relatively cheap small property.But at the same time,it also makes the number of small property houses in rural collective construction more and more out of hand,and becomes one of the problems to be solved urgently in our country.The central government has promulgated laws and regulations and tax policies on the management of small property right houses in order to guarantee the management of small property right houses through legal channels.Put forward not only from the source to prohibit the development and construction of small property,but also in its sales process to carry out full supervision,in order to achieve zero new small property zero sales.But overall,the current policies and measures have not achieved better practical results.Local governments to solve the problem of small property rights housing policy formulation and implementation,often encounter buyers and sellers,developers run away and other problems,resulting in small property housing solutions slow progress.Of course,some scholars believe that the local government's planning and policy of small property housing seems to be loose signs,calling on all localities to explore effective ways to deal with small property housing according to law to learn from experience.Therefore,this paper starts from the current policy and effectiveness of small property right housing under the combing of existing literature.Through the analysis of the current laws of our country and the implementation of local policies,the situation ofsmall property houses under the existing policies is obtained.Secondly,from the point of view of our Constitution,it is concluded that collective land and state-owned land should have the same status.It is pointed out that entering the market of small property right house by legal means is not only beneficial to the protection of the living standard of the middle and lower class people in our country,but also to the protection of the legitimate rights and interests of farmers from being infringed.More importantly,it is conducive to the increase of national tax revenue and the maintenance of the healthy and stable development of the urban real estate market.Then the case analysis of land policy under the small property development dilemma and its causes.Finally provide the method and path to realize the legalization of small property right house.The classification of small property houses,and the establishment of a supporting administrative implementation system and social security system,as well as the fundamental implementation of the improvement of the Land Management Law,while protecting the legitimate rights and interests of property,small property housing for the solution to reduce worries.
