Research On Countermeasures Of Environmental Pollution Crime Cases Investigation

Under the quick social and economic development,the level of industrialization of the whole society has been increasing rapidly,yet,unfortunately,people's awareness of environmental protection has not been able to keep up the pace with the economic development.Driven by the maximization of economic benefits,some people put themselves at risks by getting economic profits through severely damaging the environment.This has led to a sharp increase in the number of environmental pollution crimes,which has seriously affected the physical health of our citizens and also devastate the natural environment on which we depend for survival.It has become the consensus of the society which values “the lush mountains and clear water than the mountain of gold and silver”.It has become an important task for the public security organs to crack down on the crimes of environmental pollutions efficiently and in the meantime,initiate the investigation towards these crimes.In this paper,through the investigation and research of the actual cases of the environmental pollution,we find the features of this particular category of crime and the practical difficulties in the investigation of the public security organs.Through the illustration of status such as the number of cases of environmental pollution crime,the judgement of the crime,and the efficiency of investigation,the paper summarizes the characteristics of the results,means,purposes and regions of environmental pollution crime.And it focuses on the practical difficulties faced by the investigation of these crime cases.Through the combination of on-the-spot investigation and relevant cases,it finds out that there are four difficulties in the investigation of the environmental pollution crime.They are:lacking the clues for investigation,difficulty in establishing a case,the difficulty in connecting the administration and jurisdiction,and the difficulty in the judiciary identification as well as the inadequacy of professional staffs.Result the low effiency of ending cases and investigation.In this regard,we should focus on solving the practical difficulties from the physical perspectives.It is necessary to establish a cooperative platform between the investigation organ and the administrative law enforcement department,standardize the identification system,establish a judicial identification system for environmental pollution crimes,guarantee the enforcement of it,and carry out the professional construction of the investigation subject through unblocking the source channels of clues,prioritize the investigation gateway and further connect the administration and judiciary departments.Four measures should be taken to improve the efficiency of investigation: solve the practical difficulties in the investigation of environmentalpollution crimes;effectively improve the effect of attack;consolidate the results of investigation and improve the construction of investigation system.
