With the vigorous development of the our country economy,the folk lending to its convenient,flexible and efficient characteristics has grown into one of the important means of financing,by absorbing the social idle funds become rational supplement of the formal financial,the development of private lending in the development of micro,small and medium enterprises to provide the credit deficiency in the early years of development funds,to a certain extent,ease the common people in need,can say in the financial markets play an irreplaceable positive role.However,due to the development of China's financial legal system,there is still a process,the lack of effective regulation on private lending activities,which leads to a lot of side effects of private lending when it is booming,and non-standard lending procedures lead to usury and civil disputes.Throughout the development of folk lending in our country,we did not take a laissez-faire attitude towards folk lending,but showed a trend of tolerance to strict and gradually standardized.First of all,this paper starts with the current situation of folk lending,the current situation of legal regulation of folk lending and judicial practice to pave the way for the following issues.Then,through the theory and practice,this paper expounds the deficiencies in the supervision and legislation of folk lending.In terms of the current legal regulation of folk lending in China,there is no special legislation on folk lending,and there is no immediate supervision mechanism.Finally,this paper discusses the causes of the legal regulation problems in China and puts forward some Suggestions to regulate the lending by law,so as to promote the healthy and standardized development of China's financial system in the framework of the rule of law.
