With the restructuring of Public Security Fire Fighting Force and Armed Police Forest Force,and the reformation of laws and regulations such as the Fire Prevention Law,the China's Fire Fighting and Rescue Force system have changed from the active service force system supplemented by professional system to a new system,in which the National Comprehensive Fire Fighting and Rescue Team is the main force,and the professional firefighters is the supplementary force,and a variety of volunteer rescue forces participating in together.In reality,the top issue faced by the fire fighting and rescue team is the nature of the fire fighting and rescue activity,which is not only related to the drafting work of laws and regulations such as Fire Fighting and Rescue Team Law,but also related to the judicial practice of fire fighting and rescue activity by the Fire Fighting and Rescue Team.Through the analysis of the concept,nature,characteristics and tort liability of fire fighting and rescue activities,it comes to the conclusion that the tort liability of fire fighting and rescue activities mainly refers to the tort liability of the "National Comprehensive Fire Fighting and Rescue Team".After deep learning of the realistic and theoretical basis of the National Comprehensive Fire Fighting and Rescue Team fire fighting and rescue tort liability immunity,the author considers that the laws and regulations can ensure the Fire Fighting and Rescue Team "The Right to Sue and Defend firstly",and directly grant the immunity from tort liability when time is right.Hoping that through the joint efforts and long-term progress of all fire fighting and rescue teams,it can be achieved to provide a good fire-safety environment for the realization of "The Two Centenary Goals".
