Research On The Electronic Evidence In The Application Of Law

Due to the development of the internet and information technology,electronic data has beused frequently.Electronic evidence has gradually become one of the main evidences to solve civil disputes,especially in the field of the civil cases.The first chapter of this article is an introduction,which has the research on the legislative status of electronic evidence at home and abroad,and the significance,methods and innovations of the electronic evidence.The second chapter is an overview of electronic evidence.The third chapter describes that the present situation and reasons of the application of Electronic Evidence?The fourth chapter is the relevant subject of the electronic evidence rules are not complete,relevant research on preservation,appraisal,evidence collection and the rules of electronic evidence authentication,etc.have not yet been clarified,increasing the burden on the litigant and making the court's trial more difficult to some extent.The fifth chapter can concluded in the following five aspects about the suggestions: Regulating the research on the relevant subject of the electronic evidence;Regulating the research on the preservation of electronic evidence;Regulating the research on the collection of electronic evidence;Strengthening the research on the aspect of appraisal;and the research on the authentication of electronic evidence by innovative trial methods and proof methods.This article is expected to do something according to the study of theory and related research,first of all,it will enable legal persons to shape their basic and related cognition of electronic evidence.In addition,it is necessary to define legal and technical forms,in order to make the certified electronic evidence truly lawful,and obtain legal and effective electronic evidence.Pay attention to the problems and solutions of electronic evidence,after obtaining evidence effectively,it will have a great effect on the current society for punishing related illegal crimes and applying electronic evidence better in future development in China.
