Research On Legal Problems Of PPP Mode Supervision In China

The PPP model is a new type of public-private cooperation model,and the PPP model supervision is a lawful regulatory activity of the PPP project by the regulator.It can reduce the risks that exist in the process of PPP projects,ensure that PPP projects can obtain more excellent benefits,and also promote PPP projects to give full play to their effectiveness and better achieve their goals of serving the public.However,in view of the current status of my country's PPP mode operation,there are obviously many problems in the process of project operation.The main reason is that the legal system of PPP model supervision in my country is not perfect,the content of supervision is not clear,the main body of supervision is not clear,and the evaluation mechanism and disciplinary mechanism are lacking.The existence of these problems will affect the quality and efficiency of the PPP project and the profit of the project operating company.This also means that we need to further promote the improvement of the legal system of PPP model supervision.The thesis is based on finding and solving problems.The focus of the research is on the existing problems and improvement suggestions of my country's PPP model regulatory legal system.The full text is divided into seven parts:The first part is an introduction,which mainly introduces the background of the topic selection and the practical significance of the research,summarizes the main research views at home and abroad,lists the methods used in the research,and summarizes the main innovations of the paper;The second part is a theoretical overview of PPP model supervision.It mainly analyzes the legal connotation,legal attributes,legal value and theoretical basis of PPP model supervision from the perspective of legal theory;The third part is the legal construction process of my country's PPP model supervision.It mainly combs the four legal construction stages of exploration,trial,innovation and acceleration of the supervision of China's PPP model.The fourth part is the legal problems of my country's PPP model supervision.There are mainly unsound legal systems,unspecified content,unreasonable subject settings,inadequate subject institutions,and imperfect operating mechanisms.The fifth part is the investigation and reference of foreign PPP model supervision legal system.Mainly to inspect the legal system of PPP model supervision in the UnitedKingdom,the United States,Germany and France,and to summarize experience;The sixth part is the perfect suggestion of my country's PPP model supervision legal system.It mainly analyzes on the aspects of improving the legislation of PPP mode supervision,clarifying the legal subject of PPP mode supervision,and improving the operation mechanism of PPP mode supervision,and puts forward suggestions for improving my country's PPP supervision legal system.The seventh part is the conclusion.This paper summarizes the main idea of the paper and proposes the necessity of further research.
