Research On The Processing Model Of Criminal-civilian Cross-case

The construction of the rule of law in our country is constantly improving,and the legal system is more perfect than before.However,the rapid development of the market economy has led to an increase in the number of criminal and civil inter-departmental law cases,and the frequent occurrence of criminal and civil procedures in judicial practice.Therefore,there is an urgent need for a breakthrough in the application of laws and the choice of processing modes.However,China's current laws and regulations do not make systematic provisions for the trial of criminal and civil cross-cases.Therefore,from the typical case of practice,the focus of the contradiction between criminals and civilians is summarized,and the existing system norms and case trial experience are considered,and a processing mode that can be applied to deal with such cases is summarized,so as to truly solve the practical difficulties.This article takes the research on the screening and processing mode of criminal-civilian cross-cases as the overall framework.Chapter I introduces a complex criminal-civilian cross-processing problem through a typical contract fraud case;Chapter II locates the criminal-civilian cross concept and clarifies the classification of cases And the general characteristics of the cases in practice;Chapter III comparatively analyzes the litigation model inside and outside the criminal-civilian cross-cases and analyzes the enlightenment to the construction of our country's processing model;Chapter IV analyzes the current predicaments and practices of criminal-civilian cross-cases in practical handling Harm;Chapter V puts forward the perfect opinions on the choice of processing mode.The handling of cross-criminal cases in China should be based on the principle of giving priority to civil liability,with the protection of the legitimate rights and interests of the victim as the focus,and the introduction of guiding cases should be emphasized.And the application of policies to ensure that criminal and criminal cases can better balance fairness and justice.
