Research On The Application Of Artificial Intelligence In The Field Of Evidence Judgment

Under the background of comprehensively deepening the reform of judicial system in China,it is the general trend to build a "smart court" based on the forefront of the times with the help of modern science and technology such as artificial intelligence.Evidence is an important part of every case.There are already cases of the application of artificial intelligence in evidence adjudication at home and abroad,but there are still many problems to be solved and improved,Under the special situation of the outbreak of new coronavirus pneumonia in China in 2020,courts at all levels are actively exploring by non-contact way to solve the problem of justice,which further proves the prospect and necessity of AI in the field of evidence judgment.This paper aims to further improve the application of artificial intelligence in the field of evidence judgment,to explore the problems and solutions of the application of artificial intelligence in the field of evidence adjudication.In addition to the introduction,the article is divided into four parts:In the first part,the application practice of artificial intelligence in the field of evidence judgment explains what is artificial intelligence and the principles of evidence judgment,and the application of artificial intelligence in the field of evidence judgment is illustrated by taking "Shanghai criminal case intelligent assistant case handling system" as an example in China and "artificial intelligence trial prediction program" in foreign countries as an example.The second part explains the value and significance of the application of artificial intelligence in the field of evidence adjudication,which not only helps to improve the efficiency of handling cases of judges and litigation participants,but also has important significance for the judicial construction and the prevention of corruption in China.The third part focuses on the problems faced by the application of artificial intelligence in the field of evidence adjudication.Artificial intelligence needs a lot of data support,and its own algorithm is prone to problems.In addition,it restricts the discretion of judges to a certain extent,which easily leads to the emergence of "evidence centralism",and the allocation of responsibility is not clear in the process of application.The fourth part focuses on the problems mentioned in the third part,and explains how to better apply AI in the field of evidence adjudication,which is also the focus of this paper.expect to build optimization model about artificial intelligence evidence,guarantee "trial centralism",establish standardized and unified judicial database,standardize algorithm system,make decision-making process transparent,and establish through legislation Judicial workers' principles of final judgment and evidence review better realize the construction and application of artificial intelligence in the field of evidence judgment,and meet the arrival of the new era of artificial intelligence with a more stable attitude.
