Research On Short Video Copyright Protection

As a new type of entertainment culture,short video has been developing slowly for more than a decade.In recent years,with the rapid development of the Internet and technology,the development of short video has ushered in a golden stage and become an indispensable part of mass entertainment.However,in the process of short video development,there are also many copyright infringement phenomena,which are mainly manifested in two aspects: first,short video production process infringes the copyright of others' works;Secondly,the copyright of both short videos is infringed by others.This reflects an important issue in the development of short video industry: whether short video is the object of copyright protection;If a short video is a work protected by copyright law,what kind of work should it be? How to define short video copyright owner;Which right of the obligee is infringed by the unauthorized dissemination of the short video;How to protect short video copyright.In-depth study of these core issues and specific and feasible legal countermeasures are not only helpful to protect the legitimate rights and interests of the right holders,but also can promote the healthy and long-term development of the short video industry.This paper mainly USES comparative analysis,empirical study method,logic analysis and other traditional methods of law,of short video works on whether to belong to the copyright law,the short video copyright infringement cognizance and what kind of specific type,the tortfeasor shall bear tort liability,and prevent the happening of the short video copyright infringement and so on has carried on the comprehensive analysis.The article has five parts:The first part of the introduction,mainly including the purpose of the topic,the significance of the topic,the status quo of research at home and abroad,research methods,etc.,mainly for the following focus on the content of the introduction to make a background.The second part mainly analyzes the characteristics and classification of short videos.On the basis of a very clear understanding of short videos,this part mainly discusses whethershort videos are works protected by copyright law in China,whether short videos in network communication can be protected as works,and what types of short videos should be protected as works.The third part analyzes the typical cases of short video copyright infringement and sorts out the types of short video copyright infringement.Then,the author probes into the causes of copyright infringement of short video and expounds the shortcomings of copyright protection of short video based on the current status of copyright protection in China.The fourth part mainly expounds the liability form of short video copyright infringement and how to calculate the economic loss of copyright owner after short video copyright infringement.It is difficult to accurately calculate the economic damage caused by the infringement of short video.In addition,the article also analyzes the application of exemption in the determination of tort liability.The fifth part is the auxiliary measures of short video copyright protection in China.The auxiliary measures mainly include the reasonable application of copyright registration system and technology protection measures.This paper analyzes the protection of short video copyright by these two auxiliary measures.
