Research On The Legal Regulation Of The Use Of Antibiotics In Aquaculture

In 2018,China's poultry meat output totaled 4.94 million tons,an increase of120,000 tons or 0.6 percent compared with 2017.The output of poultry eggs was31.28 million tons,an increase of 320,000 tons or 1.0%.The production of eggs and live poultry has increased considerably compared with the previous year.But this achievement has been achieved through the misuse of antibiotics at the expense of the environment,human health and reduced product quality.There are many problems in the use of antibiotics in the breeding industry,the main problems include the residue of antibiotics in animal-derived food,the excessive content of antibiotics in feed,the supervision of antibiotic products,the prohibition of antibiotic products and so on.Therefore,in order to breeding industry in the use of antibiotics,the perspective of legal issues,first,from antibiotics for livestock and poultry epidemic prevention and cure function and promote the role of the growth cycle analysis,combined with externality theory,summarized the breeding of using antibiotics on product quality,export trade,human health and the influence of the ecological environment.Second,it analyzes the relevant veterinary drug policies in China,and explores the problems of antibiotic utilization standards,the responsibility of law enforcement bodies and utilization bodies,the lack of legal basis and public participation behind them.Third,draw lessons from the legal experience of the United States,Japan and other countries in the use of antibiotics.Fourth,combining with the utilization of antibiotics in China's aquaculture industry and relevant legal provisions,the basic theories of antibiotic utilization standard documents are clarified to provide theoretical support for the formulation of legal norms of antibiotic utilization in the aquaculture industry.The principle of integrity,ecological benefit and combination of science and practice are the basic principles of antibiotics utilization in aquaculture industry.Establish a legal standard system for the utilization of veterinary antibiotics,improve the standard for the rational utilization of veterinary antibiotics,unify the standards for the highest residue of all kinds of antibiotics,formulate the standards for the discharge of pollutants of antibiotics,and enhance the effectiveness of standards related toantibiotics.Antibiotics products detection system at the same time,combining ecological red line and the environment standard theory,with green development as the basic principle,set environmental quality standards,antibiotic production inspection standard and inspection before antibiotics content standards,to ensure the safety of food of animal origin,guarantee the development of China's export trade of products of animal origin;On the basis of the above antibiotic standards,the public participation system should be guaranteed.Clarify the legal responsibility of the subject of antibiotic supervision and utilization to ensure the smooth progress of the accountability work;Finally,the fund system related to environmental remediation should be improved to ensure the smooth progress of environmental remediation from the aspects of capital,technology and personnel.
