While the development of the live video games has brought great profits,there is a demand for distributing and protecting the profits.To this,the copy right of the live video games and its ownership should be defined.On the one hand,the overall pictures of the electronic sports games,which are as same as the pictures of sports games,reflect the competition between person and person instead of the contents of literature,arts or science.They should not be considered as works because only some scattered elements of the games constitute works.The added commentary,the short cuts or other contents of the network anchor,who may be an individual or the organizer of the electronic sports games,has no originality.They can merely make the live pictures of the electronic sports games constitute video recordings rather than works and the neighboring right belongs to the network anchor.On the other hand,the live pictures of non-electronic sports games are a portion of the overall pictures of the game in nature,which have originality and belong to the works similar to the movies.The ownership of these live pictures belongs to the developer of the games.The network anchor's operation of these non-electronic sports games may constitutes performance and the network anchor enjoys the right of performer.Based on this,whether the copyright owner has the right to regulate the live network screen of video games should be analyzed.Those live games without permission infringe upon “the other copyrights that should be enjoyed by the developer of the games and can not constitute the fair use of the works in the games.According to this,the mechanism of the live games should be perfected.To be concrete,its legislation should be improved,the application of laws should be regulated,industry regulations should bemade,and the permitted copyright platform should be established.By these means,the frequent infringement upon the market of the live games can be dealt with so as to promote the more standard and effective operation of the market of the live games.
