Research On Li Dazhao’s Constitutional Thought

Li Dazhao,an outstanding revolutionist in Chinese history and one of the founders of the Communist Party of China.He has made a deeply study on politics and law,and constantly improved and developed his thoughts in practice by laying stress on political practice.His thought of democratic constitutionalism not only embodies the strong desire of advanced intellectuals to save the nation from subjugation,but also shows their deep understanding of political and legal modernization.Li Dazhao’s constitutional thought reflected his unique social background and personal experience,mainly consisting of three parts: democracy,federation and political party.First of all,Li Dazhao combined democracy with constitutionalism and unified constitutional ideology in socialist democracy.Then,he expounded the concept of federal constitutionalism from the perspective of constitutional origin of federalism,national unity and local autonomy and the connection between federalism and democracy,and put forward a great idea of changing from capitalist federalism to socialist federalism.In the last step,with the continuous understanding of political parties from the political parties of Beiyang Government to the Kuomintang and then to the Communist Party,Li Dazhao constantly pondered and constructed the political party system in the constitutional system.The origin of Li Dazhao’s constitutional thought mainly comes from the thought of "Rule of People’s Will",the harmonic view,and the western democratic constitutional thought including Marxism.His constitutional thought has exerted an indelible historical influence on the new democratic constitutionalism of the Communist Party of China,the policy of early federalism and the leadership of the Party,and even still has important enlightenment significances for construction of the rule of law nowadays.
