Research On External Supervision In Supervision And Restriction Mechanism Of Supervisory Commission

Since the supervision law of the People's Republic of China was promulgated and took effect in March 2018,the supervisory commission,as a specialized supervisory organ in China,has the right to independently exercise the right of supervision,and its scope of supervision has been extended to all public officials exercising public power.As a powerful state institution,the supervisory commission,if it lacks effective supervision and restriction,will lead to serious consequences such as abuse of supervisory power,violation of basic human rights of citizens,and difficulty in realizing the goal of rule of law.Therefore,in order to improve the effectiveness of the supervisory commission against corruption and prevent its power from being abused,it is necessary to strengthen effective supervision and restriction.In view of the fact that the external supervision problem in the supervision and restriction mechanism of the supervisory commission is controversial and less studied in practice,this paper will take it as the research object,and try to make a comprehensive analysis of the problem through the discussion of three parts,and make the problem of the lack of external supervision of the supervisory commission be effectively solved.The first part sorts out the existing legal basis for external supervision of supervisory commission and discusses the necessity of external supervision.The second part sums up the problems and finds out the reasons for the difficulties faced by the external supervision.The third part lists suggestions to improve the external supervision mechanism.At present,China's laws have stipulated the subject,method and procedure of supervision and restriction on supervisory organs,but there are still many problems in the external supervision and restriction on supervisory commissions.However,the external supervision of the supervisory commission still have many problems.For example,as the National People's Congress has a single means of supervision and a lack of procedural provisions,which leads to the fact that the supervision of the NationalPeople's Congress is often a mere formality in practice.In addition,as the supervisory commission's status is virtually higher than that of judicial organs and law enforcement departments,it is difficult to form effective supervision.Moreover,the opacity of supervision information leads to the lack of obvious supervision role of the masses over the supervisory commission.This paper will make a detailed discussion on the above four aspects,with the purpose of placing the supervision right under supervision and restriction,and finally establishing the authority of the supervisory commission.
