Study On The Legal Issues Of Freedom Of Goods Transit In The Background Of "Belt And Road" Initiative

Since the implementation of the "Belt and Road" initiative,the global freight volume has increased rapidly along with the opening up of the major economic corridors and maritime lines.It is an important task for us to achieve fast,convenient,efficient and low cost delivery of goods,which puts forward higher requirements for the degree of freedom of transit.With the development of the global economy,the connotation of freedom of transit of goods has been enriched and developed.After the evolution and development of the ITI Convention,GATT1994,TRIPs,Agreement on Trade Facilitation.It is widely used in international trade.However,some developed countries believe that the above-mentioned international treaties can't meet their requirements of strengthening the protection of intellectual property rights.They have created new international treaties to restrict the freedom in order to strengthen the customs supervision,which has repeatedly threatened the freedom of transit of goods.Besides,during the implementation of the "Belt and Road" initiative,the freedom of transit of goods is also facing other problems and challenges in practice.From the international and domestic,theoretical and practical perspectives,Based on the "Belt and Road" initiative,through comparative analysis of international treaties and international practices that encourage and obstruct the transit of goods,this paper discusses the problems and challenges faced by goods transit freedom,and puts forward the Countermeasures for the protection of transit freedom of goods.This paper is divided into three chapters.The first chapter analyzes the basic legal principles of the freedom of transit of goods under the "Belt and Road" initiative,briefly introduces the meaning of freedom of transit of goods,expounds the basis of international law on the freedom of transit of goods,and clarifies the significance of the freedom of transit of goods,pointing out the particularity of the freedom of transit of goods under the "Belt and Road"initiative.The second chapter deeply analyzes the problems of international legal obstacles to the freedom of transit of goods under the background of the "Belt and Road" initiative,the domestic law and practice dilemma along the line,and the inadequacy of China's system and practice.The third chapter discusses the countermeasures to promote the freedom of goods transit in the context of the "Belt and Road" initiative,proposes ways to overcome the obstacles of international legal obstacles,get rid of the domestic laws and practices in the country along the line,and improve the relevant systems and practices in China.
