With the continuous development of the market economy,the administrative monopoly has become increasingly fierce.How to better regulate administrative monopoly has become a problem.The three cases of the main case are analyzed by the abuse of administrative power and the exclusion of restrictive competition in the Shenzhen Municipal Health Commission.The first controversy is the illegal subject in the administrative monopoly law enforcement.It is determined that the National Development and Reform Commission has only dealt with the illegal matters of the Shenzhen Municipal Health Planning Commission in this case,but there are many illegal subjects in the case,and it is not appropriate to make an illegal determination of one illegal subject;the second focus is administra tive The legal responsibility of monopolizing illegal subjects,the National Development and Reform Commission only requires rectification of the illegal activities of the Shenzhen Municipal Health Planning Commission,and its penalties are seriously misma tched with the illegal degree of the Shenzhen Municipal Health Planning Commission,and legal responsibility is to maximize the legal authority.Effective means,therefore,the legal liability of all illegal subjects is the core of administrative monopoly law enforcement;the third controversy is the issue of the rights relief of the victim,the so-called "there is a right to have relief",in the case The illegal act will inevitably have the existence of the victim,and how the victim will relieve the law right is the key,the focus of the dispute through legal analysis of the proposed measures corresponding to lack of administrative monopoly Law Enforcement.
