Legal Aspects Of The Investment Promotion In The Republic Of Tajikistan

The object of the thesis is analyzing the rules of the regulating investment relations arising in the process of investing by investors in the territory of the Republic of Tajikistan.The subject of research is the legal norms of both international and national legislation governing investment relations.The thesis comprises of four chapters.The first chapter describes the preliminary introduction of Investment and formulation of the objectives of the study.It also embodies the statement of the problems,research question,objectives of the study,the significance of the study and the methods which researcher applied during the study.Chapter two of the thesis is to clarify the interaction of national and international legal regulation of investment relations and analyzes the classification of international legal acts in the field of investment.This part explains the importance of international legal regulation of investment relations and the recognition of international laws by the state.This part especially explained the role of Washington Convention “Convention on the Settlement of Investment Disputes between States and Nationals of Other States” and Seoul Convention “On the Establishment of a Multilateral Investment Guarantee Agency” for investment development of the country and the World.Chapter three of the thesis analyzes the role of the investment contracts to investment promotion,types of investment contracts and proposal for addition of definition of investment contract on Civil Code of the Republic of Tajikistan.Chapter four the thesis analyzes and explains the resolution of investment disputes on the basis of national legislation and the relationship with international law in this direction and developing institution of the international commercial arbitration in the Republic of Tajikistan.Chapter five is about conclusion and recommendations.This chapter analyzes some recommendations such as importance of recognizing Washington Convention “Convention on the Settlement of Investment Disputes between States and Nationals of Other States” and changing and improving the meaning of investment dispute in the Law of the Republic of Tajikistan “On Investments”.
