The Judicial Police's Power And Restriction

Article 2,paragraph 2,of the People's Police Law regulates that:The people's police include the public security organs' police,state's security organs' police,prisons' police,reeducation through labor organs' police and the judicial police.The judicial police is not only a kind of people's police,but also an important part of the people's court.It is directly under the leadership of the court,through the implementation of security,execution and other auxiliary powers,to prevent,stop and punish violations of the various types of trial activities to ensure the trial activities in an orderly manner.Therefore,the judicial polices' power directly affected the order of judicial,the authority of judicial,the fairness,justice and the safety of the participants.We have to admit that the judicial police played an important role in protecting the security of court and the order of trial.But in reality,the judicial police exercise power illegally,who will supervise the law enforcement,where is the boundary of the judicial police and some other problems can't be ignored.With the development of the economy and the increase of the business volume of the courts,the social contradictions are also constantly diversified and sharpened objectively requires to further clarify and standardize the jurisdiction of the judicial police.However,the existing legislation on the judicial police is relatively weak,and the research work is also lack of systematic.Although the Supreme People's Court has made some special provisions on the judicial police,but the provisions of the body,content and other aspects are lack of rationality and scientific.Although the three major procedural law involves the power of the police,the content is quite scattered.The lag of the study on the judicial police power has objectively led to the one-sided understanding of the judicial police power.Therefore,this article will be based on the judicial police power,pointing out the problems in the actual operation of problems of judicial police,and then put forward some corresponding reforms combining with the current judicial reform of the actual situation,topromote the judicial police scientific,reasonable and lawful exercise of their powers,and then think about the judicial police's future development path.
