Specific Party Several Problems Involved In The Bribery Crime Research In China

As socialism with Chinese characteristics enters a new era,the construction of national legal system has also entered a new historical stage of development.The construction of anti-corruption and honesty has achieved some results,but the situation of anti-corruption struggle is still grim,especially the crime of corruption and bribery is becoming more rampant and frequent,and showing new historical characteristics increasingly.Typically,the crime of joint bribery involving specific stakeholders is a common form of bribery crime.Type.At present,there is no clear legal and judicial interpretation to adjust this content in China’s legislation.In practice,many cases courts can only acquit specific parties or convict,sentence and punish them for other related crimes because of insufficient evidence.By analyzing the deficiencies of legislation and judicial practice in China,this paper makes a comparative analysis of the different views of the academic circles,draws on the advanced theories and legislative experience of foreign countries,discusses and studies the four elements of the criminal constitution of joint bribery involving specific parties,and puts emphasis on putting forward practical and relevant suggestions to improve the bribery of specific parties,with a view to the judicial reality of our country.Relevant problems in practice can be solved smoothly,and the problem of joint bribery crime by specific parties can be reduced.
