China's network platform employment involves a wide range of areas such as network car,shared bicycle,shared car,online live broadcast,internet finance,online catering,Internet medical treatment,etc.The complexity and particularity of its employment types have had a great impact on traditional labor relations.It has shaken the theoretical basis of traditional labor legal relations and triggered a series of practical problems.In order to solve these problems,it is necessary to start from the influence of the employment of the network platform on the elements of traditional labor legal relations,and specifically analyze the changes in the subordinates,labor behavior,labor conditions,labor rights,and network platform obligations of the labor subject.In response to these changes,it is necessary not only to theoretically discuss the nature of the employment of the network platform and the elements of labor and legal relations,but also to increase the flexibility of the intermediate type of labor subject,the object of inclusive labor legal relationship,and the protection of the rights of workers working on the network platform;It is also necessary to make recommendations from the legal level to standardize the labor relations of the network platform in China,such as downplaying the characteristics of the traditional labor relations,establishing the adjustment mode of “government supervision + industry self-discipline + characteristic trade unions”,and harmonizing the content of the main responsibility of the network platform.The standard of identification,etc.
