The Present Situation,Reasons And Countermeasure Suggestions Of The Disputes On The Transfer Of Agricultural Land

In the report of the Nineteenth National Congress,it was proposed to implement the strategy of Rural Revitalization and continue to deepen the reform of rural land system.Therefore,how to guide and improve the scientific and effective circulation of rural land has always been one of the key issues of agriculture,rural areas and farmers.With the rapid development of industry,the acceleration of urban process and the sustainable development of agriculture in China,rural labor force continues to flow into cities,new agricultural subjects appear,and the transfer of personal land has become an inevitable trend.In the process of land transfer,various factors lead to a series of disputes.In my paper,I used the ways of questionnaire?statistical and case analysis.Sometimes the other research methods are used to analyze the current situation of farmland transfer and the main reasons for the controversy.Through sorting out the questionnaires of land transfer in 160 villages in Hunan Province and studying the cases of land transfer disputes,this paper clarifies the types of rural land transfer disputes,probes into the causes of rural land transfer disputes,and discusses the problems and solutions of preventing and resolving rural land transfer disputes.Based on 160 questionnaires,this paper first focuses on the development of land transfer at home and abroad,the background of land transfer disputes and research significance.The research contents,research methods and technical routes are described,and the innovations and shortcomings of this paper are pointed out.Secondly,it elaborates the specific concept of land transfer and related theoretical basis.This paper focuses on the theoretical basis of behavioral economics,demand and supply theory,land property rights theory and land contract.This paper introduces the concrete concepts of land,land circulation and its forms.Then it analyses the current situation of land transfer and disputes in Hunan Province.This paper introduces the basic situation of Hunan Province,and then collects the current situation of land transfer from the willingness to transfer,the form of transfer,the object and use of transfer and the scale of transfer by means of questionnaire survey.According to the current situation,the main types of land transfer disputes are summarized as follows: the types of land transfer disputes mainly include the non-standard signing of agreements;the disputes of land contractual management rights transfer;rural women's rights transfer disputes.The circulation disputes and reserved mobile circulation disputes caused by interest.And the typical cases of land transfer disputes are analyzed.According to the current situation of the transfer disputes,the causes of rural land transfer disputes are analyzed.The main reasons are as follows: first,the transfer procedures are not standardized and the content of the transfer is illegal;second,the management system of grass-roots organizations is not perfect;third,the legal consciousness is weak and the disputes are difficult to mediate;fourth,the land property rights are unclear and farmers lack awareness.According to the causes of land transfer disputes,this paper provides corresponding countermeasures and suggestions: firstly,to fulfill the transfer contract and standardize the transfer procedure;secondly,to strengthen the supervision and management of rural land transfer by management departments;thirdly,to strengthen legal publicity and education;fourthly,to improve farmers' legal awareness of rural land transfer;fifthly,to play the role of a bastion of grass-roots fighting to resolve contradictions and disputes;and sixth,to establish.Mobile courts to protect the vital interests of farmers...
